This manual is prepared for LNS Corporation (Pty) Ltd, owner and operator of HomeMapr.com, to assist members of the public in requesting access to records held by the company.

The Information Regulator explains that a PAIA Manual is a guide that sets out what information is available and the procedures to access records from public and private bodies.

2. Information Officer

For a private company, the head of the private body is generally responsible for PAIA and POPIA compliance unless a person is formally appointed or delegated.

3. Purpose of This Manual

This manual explains:

  • the records held by HomeMapr / LNS Corporation (Pty) Ltd;
  • how a person may request access to records;
  • the process for submitting a PAIA request;
  • the timeframes for responding to PAIA requests;
  • the fees associated with PAIA requests;
  • the grounds on which access to records may be refused.

4. Records Held by HomeMapr

HomeMapr / LNS Corporation (Pty) Ltd holds the following categories of records:

  • user account records — registration details, login history, account activity;
  • property listing records — listing content, photographs, pricing, status;
  • enquiry and communication records — messages submitted through the platform;
  • payment and financial records — invoices, transaction references, billing history;
  • advertising and partnership records — advertiser applications, campaigns;
  • employee and contractor records — employment contracts, payroll, tax records;
  • legal and compliance records — correspondence with regulators, legal notices;
  • technical and operational records — server logs, security incident records.

5. How to Request Access to Records

Any person wishing to request access to records held by HomeMapr must submit a written PAIA request. The request must be submitted using Form C as prescribed under the PAIA Regulations.

Requests must include:

  • the requester's full name and contact details;
  • a description of the record(s) requested;
  • the form in which access is required (e.g. copy, inspection);
  • the reason why access is requested (for third-party records);
  • proof of identity (copy of ID or passport).

6. Request Fees

PAIA prescribes the following fee structure for requests from private bodies:

  • request fee — R50.00 (non-refundable, payable upon submission of the request);
  • reproduction fees — as prescribed by the PAIA Regulations (e.g. per page copied);
  • search and preparation fees — may apply where extensive search is required.

Fees are waived for requests made by persons seeking access to their own personal information.

7. Response Timeframes

HomeMapr will respond to a PAIA request within 30 days of receipt. This period may be extended by a further 30 days in exceptional circumstances, in which case the requester will be notified.

8. Grounds for Refusal

Access to records may be refused on grounds including (but not limited to):

  • the record contains personal information of a third party who has not consented;
  • disclosure would constitute an unreasonable invasion of privacy;
  • the record is subject to legal professional privilege;
  • disclosure would harm the commercial interests of the company;
  • the record relates to pending litigation;
  • the record is protected under other applicable legislation.

9. Internal Appeal and External Remedies

If access to a record is refused, the requester may:

  • submit an internal appeal to the head of the private body within 60 days;
  • apply to a court for relief if the internal appeal is unsuccessful;
  • lodge a complaint with the Information Regulator of South Africa.
